Mineral mining license

- Mineral processing license shall be issued at the same time with the investment license for foreign individuals, organizations or joint venture organizations with a foreign party, according to the Law on Foreign Investment in Vietnam, that is guided by MTON Vietnam law firm.
- Licenses for mineral activities issued by the Ministry of Natural Resources and Environment must be registered at the Department of Geology and Minerals of Vietnam and one copy thereof sent to the Department of Natural Resources and Environment together with the enclosed map of the site of mineral activities for the purpose of notification of activities and co-ordination of management. All documents and a dossier is prepared by MTON Vietnam law firm.
- Licenses for mineral activities issued by a province or city under central authority must be registered at the Department for Natural Resources and Environment and one copy thereof sent to the Department of Geology and Minerals of Vietnam together with the enclosed maps of the site of mineral activities for the purpose of monitoring and co-ordination of management. All documents and a dossier is prepared by MTON Vietnam law firm.
A dossier shall include:
1. An application for mining license (Forms No.12 or No.12a), attached with four (4) copies of the map of the mining area compiled on the topographic base map with scale not less than 1: 2,500, with the VN2000 rectangular co-ordinate system.
2. Decision of approval of the reports on exploration results and mineral reserve issued by the competent authorities in accordance with the regulation;
3. A Feasibility Study Report on mineral exploitation accompanied by the approval in writing according to the regulation;
4. A report on environmental impacts or written registration of satisfying the environmental standards which has been ratified or certified by the competent State authorities in accordance with the provisions of the legislation on environmental protection.
5. A copy of documents proving the legal status of the applicant, certified by the State public notary, in case the organization applying for mining license is a domestic organization other than the organization granted with the exploration license; or a copy of the investment license (if any) certified by the State public notary in case the organization applying for mining license is a foreign organization or joint venture organization with a foreign party/parties.
